Terms of engagement

1. Scope

These terms apply to capture, processing and consultancy work carried out by Voxelreach B.V. The agreed capture specification forms part of the contract and takes precedence over any general description on this website.

2. Specifications and tolerances

We commit to the uncertainty stated in the specification, under the site conditions the specification assumes. Where conditions differ materially on the day — standing water, obstruction, restricted access — we will record the difference and state its effect on the achievable figure before proceeding.

3. Site access and safety

The client provides safe access, permits and any required escorts. Our crews will stop work if a site condition is unsafe, and standing time in that circumstance is chargeable.

4. Data ownership

Processed deliverables become the client's property on payment. We retain a copy of the raw capture data and control records for twenty-four months as part of our quality system, unless a longer or shorter period is agreed in writing.

5. Publication

We do not publish, reference or illustrate a client project without written permission. Aggregated accuracy statistics may include a project only in anonymised, site-level form and only where the client has agreed in the contract.

6. Third-party software

Deliverables are provided in documented open or widely supported formats. We are not responsible for behaviour of third-party software used to open them, including precision lost on import.

7. Payment

Invoices are payable within thirty days. Reverse charge applies to EU business customers with a valid VAT number.

8. Liability

Our liability for any engagement is limited to the fees paid for that engagement, except where Dutch law does not permit limitation. We are not liable for decisions taken from data used outside the stated scope or tolerance of the specification.

9. Termination

Either party may terminate with thirty days' written notice. Work completed and mobilisation costs already incurred are payable.

10. Governing law

Dutch law applies. The courts of Amsterdam have exclusive jurisdiction.
